Limitation of Liability

Under no circumstances shall the Program be held liable for any matters related to these Terms, whether arising from contract, negligence, strict liability, or any other legal or equitable theory, including but not limited to: (i) special, incidental, or consequential damages; (ii) costs incurred to obtain replacement products or services; (iii) interruptions to use, loss of data, or data corruption; or (iv) any other damages of any kind. The Program shall not be responsible for any delays or failures resulting from events beyond its reasonable control. This limitation of liability shall apply except where prohibited by applicable law.

Indemnification
